Bothy

Terms of service

The agreement between your organisation and Highland when you use Bothy. Plain words, as few as we could manage.

Last updated 24 October 2026

If your organisation needs a signed agreement, ask us at hello@madebyhighland.com and we will send one. Where a signed agreement and these terms differ, the signed agreement wins.

1. The service

Bothy is provided by Highland Creative LLC ("Highland", "we"). It reads your public website, shows you what people ask that your site does not answer, keeps your site ready for AI assistants and search engines, and, if you want it, adds a search box and a chat assistant that answer from your own pages. "You" means the organisation that signs up.

We may improve or change Bothy over time. If we take away something you rely on, we will tell you first.

2. Accounts

Highland adds the people who can sign in to your dashboard, at your request. Sign-in is by a link emailed to them. Please keep those emails to the people they are meant for, and tell us when someone should lose access, so we can remove it at once. You are responsible for what is done under your organisation's sign-ins.

3. Acceptable use

Please do not use Bothy to:

  • break the law, or help someone else break it;
  • publish content you do not have the right to publish;
  • try to get into parts of Bothy, or other organisations' data, that are not yours;
  • overload, probe or attack Bothy, or get around its limits;
  • resell Bothy, or run it for organisations other than your own, without our agreement.

If use of Bothy puts other organisations or visitors at risk, we may pause it and will tell you why.

4. Fair use of the chat assistant

Fair use. The AI assistant is included in every plan for normal use by your visitors. To protect every site on Bothy, each site has a daily safety limit set well above normal use. If a site reaches it, the assistant pauses for the rest of that day. If your site's use grows well beyond normal, we'll contact you to talk it through before anything changes. We never charge for chat use without your agreement in writing.

5. Your content and your data

You own your content and your data. That includes your website's text, your reports, and what your visitors ask on your site. We process it only to provide Bothy to you. We do not sell it, and we do not use it to train AI models.

One exception, so you know about it. On sites that send their visitors' questions to Bothy through our Craft CMS plugin, a question asked on two or more sites may be added to Bothy's standard list of questions, with no site, visitor or date attached. That list is how Bothy knows what people ask organisations like yours.

You give us permission to read your public website and to use your content to provide the service. You are responsible for having the right to publish what is on your website. How we handle personal information is set out in our privacy policy.

6. Confidentiality

We keep what you share with us that is not public confidential, and use it only to provide Bothy. We ask the same of you for anything we share with you that is not public, such as private prices. Neither of us has to keep confidential what was already public, or what the law requires us to disclose.

7. Availability

We make reasonable efforts to keep Bothy running and watch it with outside monitoring that alerts us when it is down. We do not promise a level of uptime or a time to restore service. Bothy runs on a small number of servers of our own, with no automatic failover.

If Bothy is unavailable, your website is not affected: the script tag fails quietly and your pages load as usual. We will tell you about planned work that may interrupt the service.

8. Fees and billing

Fees are the prices we quote you in writing, or those in your signed agreement if you have one. You can pay monthly, or yearly with 2 months free.

Founding pilots are free until 31 December 2026. After that the pilot becomes a paid plan at the price agreed with you, or the published price if no other price was agreed, unless you cancel before then.

We will give you at least 30 days' notice by email before a price you pay goes up.

9. Cancelling, and your data at the end

You can cancel at any time by emailing hello@madebyhighland.com. Cancellation takes effect at the end of the period you have paid for.

When your contract ends, we remove your site from Bothy. That deletes, in one step, its pages, counts, signals, reports, to-dos, call-back numbers, people, keys and search index. A few copies age out on their own: questions held for the standard list within 400 days, our database's change log within 30 days, the chat orchestrator within 3 days, Anthropic within 30 days and our email provider within 45 days. If you want a copy of your reports first, ask before the end date.

After that the script tag returns an empty script that does nothing, so please remove it from your site.

We may end the service if you seriously break these terms and do not put it right within 30 days of us telling you.

10. What the AI produces

The chat assistant's answers, and the drafts and suggestions in your reports, are written by AI. They can be wrong, incomplete or out of date, even when your own pages are right. They are not pastoral, spiritual, legal, medical or professional advice, and should not be relied on as such.

You decide whether the chat assistant is on, which topics it stays away from, and what your site publishes. The chat assistant is off until you ask for it.

11. Liability

Bothy is provided as it is. Neither of us is liable to the other for indirect or consequential losses, or for lost profits or data. Our total liability to you for anything arising from Bothy is limited to the fees you paid us in the 12 months before the claim. Nothing here limits liability that the law does not allow to be limited.

12. Governing law

These terms are governed by the laws of the State of Michigan.

13. Changes to these terms

We may update these terms. We will email you at least 30 days before a change that affects you takes effect, and change the date at the top of this page. If you do not accept the change, you can cancel before it takes effect.

14. Contact
